In case of manufacturing defect, product latent defect, malfunction, failure that would not be caused by the consumer, the manufacturer undertakes to replace the defective product free of charge, or to refund it if no replacement is possible in order to comply with the two year contract warranty.

Decision to refund or replace the product is at the manufacturer or the importer’s exclusive discretion.

The product warranty commences on sale date and will be valid upon presentation only of a clear invoice which may not be older than two years, since such is the term of warranty. To make this warranty effective, the consumer must return the defective product to the manufacturer/distributor, so that the consumer can have it replaced or else refunded.

The consumer must return the product with its accessories (cables), by-products, user manual and its packaging in perfect condition, any external deterioration of the product and/or its packaging shall prevent validity of contract warranty clause.

The consumer is required to have the product installed by a specialized professional certified by the importer, as well as to maintain and regularly tune his vehicle according to the vehicle’s manufacturer instructions and not to use or drive the vehicle in a way that is detrimental to the vehicle’s reliability. Should he fail to comply with these conditions, the importer and the manufacturer would disclaim all liability.

The consumer is sole responsible for the legality and conformity of his vehicle, in particular for a road use towards competent authorities, the vehicle manufacturer’s original warranty and his insurance company, to respect his insurance contract.

The importer, the manufacturer and the distributor/retailer/ fitter are free of fault should any loss or damage occur, caused or suffered by the product, directly or indirectly, as a main or accessory cause, whatever its nature, may it be suffered or caused by the consumer.

This clause is accepted in full and without any reserve by the purchaser by reason only of the purchase of the product E85 FFV.
